CAMPING SERVICES AT NATURCAMPING AM ELLBOGENSEE

  1. APPLICABILITY
    The following terms and conditions regulate the mutual rights and obligations between NaturCamping am Ellbogensee, owned by Coralie von Schmidt auf Altenstadt, as the owner of the campsite (hereinafter referred to as "Campsite") and the camping guest (hereinafter referred to as "Guest"). Only the printed materials valid for the travel period, both on paper and online, apply to the contractual services. Any verbal agreements, side agreements, and other arrangements, regardless of their nature, must be confirmed in writing and approved by the campsite owner in order to be effective.
  2. BOOKING
    1. ONLINE BOOKING
      1. The Guest expresses their intention to conclude a binding booking in accordance with the cancellation terms by clicking the button "Book now with obligation to pay." The rental contract for the object specified therein comes into effect with the written booking confirmation from NaturCamping am Ellbogensee, sent via email.
      2. The Guest is required to pay the total amount specified in the booking confirmation to NaturCamping am Ellbogensee within 7 days of receiving the booking confirmation. If the booking is made within 7 days before the booked arrival date, payment should be made prior to arrival.
      3. If the prepayment is not made in time or not in full, NaturCamping am Ellbogensee reserves the right to cancel the booking at a cost as per the cancellation fees mentioned in point 8 and to reallocate the rental object.
    2. BOOKING BY PHONE or EMAIL
      1. Reservations made upon written or telephonic request are considered binding within the meaning of the cancellation terms as soon as the Campsite has sent a written booking confirmation to the Guest. In particular, inquiries/quotes without confirmation from the Campsite do not give rise to any claims for the availability of the desired rental object.
      2. The Guest is required to pay the total amount specified in the booking confirmation to the Campsite within 7 days of the booking confirmation. If the booking is made within 7 days before the booked arrival date, payment should be made prior to arrival.
      3. If the prepayment is not made in time, the Campsite reserves the right to cancel the booking at a cost according to the cancellation fees mentioned in point 8 and to reallocate the rental object.
      4. A quote with an estimate may precede the booking confirmation at the explicit request of the Guest. The Guest accepts or declines the offer by responding promptly via email. The subsequent booking process is as described in 2.2.1 – 2.2.3. The offer becomes invalid without the Campsite needing to remind or notify the Guest, if the Guest does not respond to the offer within 7 days – or within the period set in the offer.
  3. ARRIVAL AND DEPARTURE
    1. For the rental accommodations the following applies:
      1. ARRIVAL: The accommodation is available from 3:00 PM on the day of arrival. If the Guest intends to arrive after reception hours, they must arrange the key handover for the rental object with mutual agreement with the Campsite.
      2. DEPARTURE: The departure should be completed by 11:00 AM on the day of departure. The key to the accommodation must be returned at the reception.
    2. For the campsites , our guests are welcome from 3:00 PM on the day of arrival.
      On the day of departure, the campsite should be vacated by 12:00 PM.
    3. If the Guest arrives after reception hours, the Campsite cannot guarantee that the Guest will be sufficiently informed to take possession of the rental object or the booked campsite.
    4. If the Guest departs before reception opens, the Campsite cannot guarantee that any deposit left will be refunded to the Guest.
    5. If the camping guest uses the rental object (campsite, accommodation) for longer than the specified arrival and departure times, they will incur an additional fee.
  4. USE OF THE CAMPSITE
    1. The rental object may only be used by the number of persons registered for it.
    2. Services utilized that exceed the previously booked scope must be reported immediately to the Campsite.
  5. CLEANING
    The accommodation is handed over to the vacationer in a cleaned state. The accommodation must be returned at the end of the stay in accordance with the conditions on the information card located in the accommodation. If the accommodation is not correct or complete from the vacationer's perspective at the beginning of the stay, they must report this immediately, but no later than two hours after arrival at the reception. Later complaints will not be considered.
  6. OBLIGATIONS
    The campsite rules apply on the campsite. By registering, the vacationer signs the campsite rules. These will be posted at the campsite. The vacationer is personally liable for all obligations arising from the conclusion of the rental agreement or the stay at the campsite, including for any third parties they have registered.
  7. PAYMENT
    Unless otherwise agreed, the Guest must make payments in EUR in accordance with the agreed deadlines.
    1. For a reservation, the Guest is required to pay the total amount specified in the booking confirmation to the Campsite within 7 days of booking confirmation. If the booking is made within 7 days before the booked arrival date, payment should be made prior to arrival.
    2. For short-term reservations, the invoice for the entire planned stay must be paid on the day of arrival.
    3. Payment for additional services used is generally made immediately, but no later than on the day of departure.
    4. The reserved period is considered binding.
    5. In case of early departure, the Guest will be charged for the reserved site and person fees.
  8. GENERAL CANCELLATION TERMS
      1. Cancellations, rebookings, and amendments must be made in writing to avoid misunderstandings.
      2. Until the arrival day of a booking, the Guest may allow a third party to replace them. This third party must be actively communicated by the Guest before the cancellation of the booking.
      3. CANCELLATION FEES
        If the Guest cancels the contract, we will charge a compensation according to §§ 651 a ff of the BGB as per the following schedule:
        1. up to 43 days (more than 6 weeks) before arrival – € 20 cancellation fee
        2. 42 to 8 days before arrival – 50 % of the rental price / at least € 20
        3. From 7 days before arrival – 90 % of the rental price / at least € 20
        4. If the Guest does not show up for their trip without notifying the Campsite and there is no case of force majeure or impossibility or breach of contract, the Campsite retains full entitlement to the booking price, minus saved expenses. This amounts to 90 % of the rental price.
  9. TRAVEL CANCELLATION INSURANCE
    The Campsite recommends that the Guest obtain travel cancellation insurance in their own interest.
  10. DEPOSIT
    The deposit amount, referred to as "Deposit", is an amount charged as an advance payment for any damages, additional expenses, or extra cleaning required due to the actions of the Guest during their stay. Any outstanding amounts may also be deducted from the deposit.
    1.  DEPOSIT FOR FAMILY ACCOMMODATIONS
      1. The deposit for rental accommodations in the "TinyHouse", "Wood Tent", or "Rental Caravan" categories is € 50.
      2. The Campsite will inspect the rental object carefully after the Guest's departure.
      3. late return of the rental object at departure will result in the retention of the deposit.
      4. The deposit will be settled within 14 days after departure and (if applicable, partially) refunded, provided the account number of the vacation guest is known.
    2.  DEPOSIT FOR FINN HUTS
      1. The deposit for rental accommodations in the "Finn Hut" category is € 35.
      2. The Guest must report to the reception of the Campsite at their opening hours upon departure. The Campsite will promptly inspect the Finn Hut carefully.
      3. The deposit will be settled immediately afterwards and (if applicable, partially) refunded in cash against receipt.
    3.  DEPOSIT FOR EXTENSION CABLES
      1. The Campsite may require a deposit for the loan of electric cables and adapters. The deposit will be refunded when the Guest returns the cable at the reception during opening hours before departure.
  11. CANCELLATION BY THE CAMPSITE
    1. The Campsite may withdraw from the rental agreement/camping contract before the rental begins if the rental object cannot be provided after the conclusion of the contract due to unforeseeable force majeure. In this case, all amounts paid by the vacationer will be refunded; further claims are expressly excluded. In this case, the Campsite is obliged to inform the vacationer immediately about the unavailability of the rental object.
    2. Furthermore, the Campsite is entitled to terminate the camping/rental contract extraordinarily without notice if the vacationer endangers others or the site through their behavior, causes significant disturbances, uses the rental object in violation of the contract, or otherwise behaves inappropriately. In this case, the vacationer must pay the entire rental price agreed upon with the Campsite.
  12. LIABILITY AND LIABILITY EXCLUSION
    The Campsite operator is only liable according to the principles of culpability in tort according to §§ 823 ff BGB, in case of wilful violations of safety obligations. The Campsite operator is not liable for damages and losses incurred by camping guests or visitors due to the actions of third parties or events resulting from force majeure. Liability for brought-in items (§§ 701 ff BGB) is excluded. Each camper assumes responsibility.
  13. PRICES
    The current price list of the Campsite applies. The Campsite is entitled to change the prices listed on the homepage if the costs calculated by the operator change.
  14. COMPLAINTS
    Any complaints regarding the rental object must be reported to the Campsite by the vacationer immediately. Claims for defects are excluded if they were not reported directly to the Campsite during the vacationer's stay. A reasonable period must be allowed for the Campsite to remedy the defect.
  15. SINGLE TRAVELING YOUTH
    Youth who have not yet reached the age of 18 must present a letter from their guardians stating that they agree to their stay at the Campsite.
    No alcoholic beverages will be sold to any youth who have not yet reached the age of 18.
  16. CAMPSITE REGULATIONS
    Part of the general terms and conditions is the Campsite regulations. These will be posted at the Campsite.
